POLICIES AND PRACTICES GOVERNING THE GOVERNANCE OF PERSONAL INFORMATION, CONFIDENTIALITY AND USE OF THE WEBSITE ("Policy")

This Policy reflects our commitment to the security and privacy of personal and confidential information (“Personal Information“) in the course of our business, including the use of our website: https://labbecoteavocats.com (“Site“).

1- OBJECTIVES

This Policy sets out how we protect personal information and specifies the standards for its collection, use, disclosure, retention, right of access and rectification.

We collect, store and process your personal information and are therefore committed to respecting the provisions, values and fundamental principles established by applicable legislation, including the Act respecting the protection of personal information in the private sector (RLRQ, c. 10- RIGHTS OF ACCESS AND MODIFICATION

Subject to the exceptions provided by law, you have the right to oppose, withdraw, access, rectify and delete your personal information at any time. In addition, there may be circumstances where we will not be able to provide you with access, for example, where such action may lead to the disclosure of another person’s personal information and that person refuses to consent to the disclosure of the information, or where the information is protected by solicitor-client privilege or other legal restrictions. In such cases, we will advise you of the reason why we cannot provide you with access to your personal information.

Upon receipt of your request for withdrawal, rectification or deletion, the processing of your personal information will be restricted until such time as the correction or deletion of your personal information has been completed. In accordance with applicable laws, we undertake to respect all requests for withdrawal, rectification and deletion, unless we are legally obliged to do otherwise.

In addition, the person responsible for the protection of personal information undertakes to notify you in the event of rectification or deletion of personal information, unless this would entail disproportionate formalities, costs or steps for him or her. We promote best practices and respect for rights in terms of transparency and protection of personal information in a variety of ways, such as informing all our employees, posting the contact details of the person responsible for personal information, and mobilizing various means of awareness such as, among others, information sessions on the protection of personal information, reminders at team meetings and an action plan for the person responsible for personal information.

13- USE OF THE SITE

You agree not to use the Site in any illegal or prohibited manner, including, but not limited to, not :

14- LIMITED LICENSE

Subject to the terms and conditions herein, you are granted a limited, fully revocable, non-transferable and non-exclusive license to access, view and use the Site for your personal, non-commercial use and to download, store and print single copies of portions of the Site and its contents for your personal, non-commercial use, provided that you retain all copyright, trademark and other proprietary notices contained thereon.This limited license does not include any rights not specifically granted herein. The limited license to use the Site and its contents automatically terminates upon termination or expiration of this Agreement (whichever occurs first). 16- LACK OF LAWYER-CLIENT RELATIONSHIP

In addition, any information sent or received over the Internet may not be secure. We cannot guarantee the security or confidentiality of any information (in any form) transmitted to the Site.

17- LIMITATION OF LIABILITY AND DISCLAIMER

We do not warrant the accuracy, adequacy or reliability of the content of the Site, including any errors or omissions. The information contained on the Site is believed to be accurate when posted. We disclaim all responsibility for your use and interpretation of the information.

We cannot guarantee that the Site will be available at all times, without interruption, or that the Site or the servers that make it possible to operate are free of viruses or malfunctions. Subject to applicable law, Labbé Côté, Avocats Inc., as well as its partners, employees, consultants, representatives, directors, officers, agents and licensors (the “Released Parties”), shall in no event be liable for any damages whatsoever, including, without limitation, any direct, special, indirect, punitive, incidental or consequential damages, or any loss or damage whatsoever relating to the loss of business opportunities, savings, data and/or profits, incidental or consequential damages or any loss or damages whatsoever relating to the loss of business opportunities, savings, data and/or profits arising out of your use of, reliance upon or inability to use the Site and/or its content, however, caused and whether arising in contract, tort (including negligence) or otherwise. The foregoing limitation shall apply even if we were or should have been aware of the possibility of such damages.

To the fullest extent permitted by applicable law, you hereby agree to hold each Released Party harmless, and in no event will the Released Parties, individually or collectively, be liable to you or any other person or entity for any liability or damages (including direct, indirect, special, or consequential damages, including lost profits) whatsoever arising out of or in connection with your use of the Site (including any breach by you of the Site), its content or otherwise in connection herewith, and you agree that your sole remedy for any claims, losses, damages or costs and expenses is to discontinue using the Site and its content. You will indemnify and hold harmless each of the Released Parties from and against any and all claims, losses, judgments, damages, costs and expenses (including, without limitation, reasonable legal fees) asserted against or incurred by any of the Released Parties arising out of your use of the Site, the Content or otherwise in connection herewith (including any breach thereof by you).

You will also indemnify and hold harmless the Released Parties from and against any claim by any third party due to your use of the Site Content. You agree that the relevant Released Party(ies) may assume the defence and control of any claim in which you are required to indemnify the Released Parties and you agree to cooperate, at your own expense, with our defence of such claims. You agree not to settle any matter without the prior written consent of the relevant Released Party(ies).

19- APPLICABLE LAW AND INTERPRETATION

This Policy shall be governed by and construed in accordance with the laws of Quebec and Canada and is written in French. In the event of a dispute, the French text shall prevail. Any dispute arising out of or in connection with this Policy shall be submitted exclusively to the courts having jurisdiction in the judicial district of Quebec City, Province of Quebec.

If you have any questions or complaints regarding this Policy or its application, you may also contact the Privacy Officer through one of the above options, who will investigate, respond diligently and take appropriate action, if necessary, including amending our policies and practices.

21- POLICY UPDATES AND MODIFICATIONS

This Policy may be updated, modified or supplemented at any time in order to comply with any legislative, regulatory, jurisprudential or technological developments. Any updates and modifications to the Policy will be published on the Site. By continuing to use the Site, you agree to be bound by any such updates and modifications.
